My Phone/Internet provider service disconnected (physically) my service do to an error on their part. They admitted that they were at fault yet refused to take responsibility for robbing us of internet service for over 48 hours. I switched my DSL service but still have the old companies phone service. They will try to slap me with cancelation fees and whatever else. I have proof, in physical evidence, that they were at fault and are guilty of consumer fraud.
What is the best way I can cancel my service and not pay the cancelation fees (they are in breach of contract and have broken laws)? What are the consumers rights when the service provider fraudulently breaks a contract?
I do not want to get into a legal struggle if I don’t have to, they have already wasted my time.

They are not guilty of consumer fraud. You need to call them and say that because of the issue that took place you cannot consider their services to be reliable and therefore want to cancel the contract. If they bring up the cancellation fees, make a point that you are not going to pay any. They had a contractual obligation to provide you with a service and they failed to do so. If they insist on the cancellation fees, ask to talk to the manager. Repeat all of the above to the manager. And insist on the 48 hours non-service reimbursement. This will resolve the issue. If the manager is VERY stupid and actually sends you the bill, wait for the bill and then take it to a small claims court. You can also report them to the Consumer Protection Agency, they will investigate them and take them to federal court on your behalf, but this route might take longer.
